Infix Management LLC (“Infix,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information we handle. This Privacy Policy explains what information we collect through our website at infixusa.com (the “Site”), through our forms and communications, and in the course of providing marketplace management, advertising, content, and analytics services (the “Services”) to our clients, and how we use, share, protect, and retain that information.

By using the Site or engaging our Services, you agree to the practices described in this Policy. If you do not agree, please do not use the Site or the Services.

1. Who We Are and How to Contact Us

The data controller for information collected through the Site is Infix Management LLC. For any privacy question or to exercise your rights, contact us at legal@infixusa.com or by mail at 300 S 4th Street, Suite 600, Las Vegas, NV 89101.

2. Scope of This Policy

This Policy covers two broad categories of information: (a) information about visitors to our Site and people who contact us or inquire about our Services; and (b) information we access and process on behalf of our clients when they authorize us to connect to and manage their third-party marketplace and advertising accounts (for example, Amazon, Walmart, Target, Google, and Meta). Where we process client-connected platform data, we do so as a service provider or processor acting on our client’s instructions, and the relevant platform’s own terms and policies also apply.

3. Information We Collect

3.1 Information You Provide to Us

When you complete a contact or inquiry form (hosted via Zoho Forms), request a strategy call, or otherwise communicate with us, we collect the information you submit, which may include your first and last name, company name, email address, phone number, the sales channels you use, and any details you include in your message.

3.2 Information We Collect Automatically

When you visit the Site, we and our analytics and advertising providers may automatically collect certain information through cookies and similar technologies, including your IP address, device and browser type, pages viewed, referring pages, and general location. See Section 5 (Cookies and Tracking) for details and choices.

3.3 Client and Platform-Connected Data

When a client engages our Services and authorizes us to access their marketplace and advertising accounts through official APIs, we may access and process business and performance data associated with those accounts. Depending on the platform and the client’s authorization, this may include seller and account information, product and catalog data, pricing and inventory data, order and sales data, advertising campaign and performance data, and a limited amount of end-customer personal information (such as names and shipping details) contained in order records. We access this data only to provide the Services the client has requested, and we handle it in accordance with Section 7 (Platform-Specific Data Handling and Compliance).

4. How We Use Information

We use the information described above to:

  • Respond to your inquiries, schedule strategy calls, and provide customer support;
  • Provide, operate, manage, and improve the Services for our clients, including account management, advertising, content optimization, and reporting;
  • Operate, secure, and improve the Site and understand how it is used;
  • Send administrative and, where permitted, marketing communications about our Services (you may opt out at any time);
  • Comply with legal obligations, enforce our agreements, and protect our rights, our clients, and others; and
  • Carry out any other purpose disclosed to you at the time of collection or with your consent.

We do not use client platform-connected data to train artificial intelligence or machine-learning models except where expressly permitted by the client and by the applicable platform’s policies, and never in violation of any platform’s Limited Use or data-use restrictions.

5. Cookies and Tracking Technologies

The Site uses cookies and similar technologies for functionality, analytics, and marketing. We may use analytics tools (such as Google Analytics) to understand Site usage, and advertising technologies (such as the Meta Pixel and Google advertising tags) to measure and improve our own marketing. These tools may set cookies and collect identifiers that allow us and the platforms to recognize your device across sites.

You can control cookies through your browser settings and, where available, through the consent banner on our Site. You can also opt out of certain interest-based advertising through the platform controls and industry tools referenced in Section 6. Disabling cookies may affect how the Site functions.

6. Advertising and Marketing Platforms

We advertise our own Services on platforms including Meta (Facebook and Instagram) and Google. In doing so, we may use pixels, tags, and audience tools provided by those platforms. We do not combine advertising data obtained through these platforms with other personal information in any manner that would identify an individual end user, and we do not use these tools in any way prohibited by the platforms’ terms.

You can manage interest-based advertising through Meta’s ad preferences, Google’s Ads Settings, and industry opt-out pages such as the Digital Advertising Alliance (optout.aboutads.info) and Network Advertising Initiative (optout.networkadvertising.org).

7. Platform-Specific Data Handling and Compliance

When we connect to third-party marketplace and advertising platforms on behalf of clients, we comply with each platform’s developer and data-protection requirements. The following disclosures describe our commitments for each program. Where a client’s engagement does not use a particular platform, that section does not apply to that client.

7.1 Amazon (Selling Partner API and Advertising API)

Our use of Amazon Information complies with the Amazon Acceptable Use Policy and the Amazon Data Protection Policy. We access Amazon data solely to provide services to the authorizing seller. We treat Personally Identifiable Information (PII) contained in Amazon order data as confidential and: (a) retain such PII for no longer than 30 days after order fulfillment, except where we are required by law to retain it for tax, legal, or regulatory purposes, in which case it is archived in an encrypted, access-controlled store; (b) encrypt PII in transit using TLS 1.2 or higher and at rest using AES-256; (c) restrict access to authorized personnel with a need to know; and (d) permanently and securely delete such data upon request or when it is no longer required for the permitted purpose. We do not use Amazon data for any purpose other than fulfilling the seller’s requested services, and we never sell Amazon data.

7.2 Google (Google API Services and Google Ads API)

Infix’s use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. We use Google user data only to provide or improve user-facing features that are prominent in our application, and we do not use or transfer Google user data to serve advertisements, to determine creditworthiness or for lending purposes, to sell to data brokers or information resellers, or to train generalized artificial intelligence or machine-learning models. We do not allow humans to read Google user data unless we have your affirmative consent, it is necessary for security or to comply with law, or the data has been aggregated and anonymized.

7.3 Meta (Meta Platform Terms and Developer Policies)

Our use of data accessed through Meta APIs is governed by the Meta Platform Terms and Developer Policies. We process Meta data only for the purposes disclosed here and to our clients, we do not combine advertising data accessed through Meta with third-party or internal PII in a manner that would identify an end user, and we honor data-deletion obligations. If you have interacted with a Meta application or asset we operate and wish to have associated data deleted, you may submit a request as described in Section 15, and we will process it in accordance with Meta’s requirements.

7.4 Walmart (Marketplace and Developer APIs)

Our use of Walmart API materials complies with the Walmart Marketplace Developer Terms and Conditions and the Walmart Privacy Policy. We collect and use Personal Information obtained through Walmart APIs only as necessary to perform the Services, we do not use it to send unsolicited communications, we do not store Sensitive Personal Information in Walmart-connected storage, and we destroy such Personal Information when it is no longer necessary for the engagement or when we cease to access the Walmart API materials.

7.5 Target (Target Plus and Roundel)

Where we manage a client’s presence on Target Plus or advertising through Roundel, we comply with Target’s applicable partner, marketplace, and advertising program terms and privacy requirements. We access and use Target-related data solely to provide the Services to the authorizing client and handle any personal information consistent with this Policy and Target’s requirements.

7.6 Other Platforms

As we build and connect additional tools and channels (for example, other retail media networks or direct-to-consumer platforms such as Shopify and Google Ads), we will apply the same standards: access limited to the client’s authorized purpose, compliance with the platform’s developer and data-protection policies, encryption in transit and at rest, and deletion when the data is no longer needed.

8. How We Share Information

We do not sell your personal information for money. We may share information in the following circumstances:

  • Service providers. With vendors who perform services for us (such as hosting, form processing via Zoho, analytics, email, and advertising), bound by confidentiality and data-protection obligations.
  • With the marketplace and advertising platforms necessary to deliver the Services our clients request, subject to those platforms’ terms.
  • Legal and safety. When required by law, subpoena, or legal process, or to protect the rights, property, or safety of Infix, our clients, or others.
  • Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to appropriate protections.

Some jurisdictions treat the use of advertising cookies and pixels (for example, sharing identifiers with Meta or Google for our own marketing) as a “sale” or “sharing” of personal information. You can opt out as described in Sections 5, 6, and 9.

9. Your Privacy Rights

9.1 California Residents (CCPA/CPRA)

If you are a California resident, you have the right to: know the categories and specific pieces of personal information we collect, use, and disclose; request deletion of your personal information; request correction of inaccurate personal information; opt out of the “sale” or “sharing” of personal information and the use of sensitive personal information beyond permitted purposes; and not be discriminated against for exercising your rights. We do not knowingly sell personal information for money. To exercise these rights, contact us at legal@infixusa.com. You may use an authorized agent, and we will verify your request before responding.

9.2 Other U.S. State Residents

Residents of states with comprehensive privacy laws (including Virginia, Colorado, Connecticut, Utah, and others as they take effect) may have similar rights to access, correct, delete, and obtain a portable copy of their personal information, and to opt out of targeted advertising, the sale of personal data, and certain profiling. To exercise these rights, contact us at legal@infixusa.com. You may appeal a denied request by replying to our response.

9.3 EEA and UK Residents (GDPR / UK GDPR)

If you are located in the European Economic Area or the United Kingdom, you have the right to access, rectify, erase, restrict, and port your personal data, to object to certain processing, and to withdraw consent where processing is based on consent. Our legal bases for processing are: your consent; performance of a contract; our legitimate interests in operating and marketing our business (balanced against your rights); and compliance with legal obligations. You may lodge a complaint with your local supervisory authority.

9.4 Canadian Residents (PIPEDA)

If you are located in Canada, you may access your personal information, request correction of inaccurate information, and withdraw consent at any time (subject to legal or contractual restrictions and reasonable notice). We process your information based on your express or implied consent, except in limited circumstances permitted or required by law, such as fraud detection and prevention, investigations, business transactions, or where required to comply with a subpoena, warrant, or court order. To exercise these rights, contact us at legal@infixusa.com. If you have an unresolved concern, you may contact the Office of the Privacy Commissioner of Canada.

10. International Data Transfers

We are based in the United States and process information there. If you access the Site or Services from outside the United States, your information may be transferred to, stored in, and processed in the United States and other countries that may have different data-protection laws. Where required, we use appropriate safeguards for such transfers, such as Standard Contractual Clauses.

11. Data Retention

We retain personal information only for as long as necessary to fulfill the purposes described in this Policy, to comply with our legal, tax, and regulatory obligations, to resolve disputes, and to enforce our agreements. Client platform-connected data is retained in accordance with the platform-specific limits described in Section 7, including the 30-day limit on Amazon order PII.

12. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information, including encryption of sensitive data in transit and at rest, access controls, and least-privilege access for personnel. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

13. Children’s Privacy

The Site and Services are intended for businesses and are not directed to children. We do not knowingly collect personal information from children under 16. If you believe a child has provided us personal information, contact us and we will delete it.

14. Third-Party Links and Changes

The Site may link to third-party websites and platforms that we do not control and that have their own privacy practices. We are not responsible for those practices. We may update this Policy from time to time; the “Last updated” date reflects the latest revision, and material changes will be posted on this page.
